ANALISIS KOMPETENSI ABSOLUT DALAM SISTEM HUKUM ACARA PERDATA INDONESIA

Abstrak

Kompetensi absolut merupakan elemen fundamental dalam sistem hukum acara perdata Indonesia yang menentukan jenis perkara yang menjadi kewenangan masing-masing lembaga peradilan. Dalam konteks peradilan agama, batas-batas kompetensi absolut seringkali berbenturan dengan jenis perkara lain yang berkaitan secara materiil. Ketidakhadiran aturan eksplisit mengenai penggabungan tuntutan antar yurisdiksi menyebabkan inkonsistensi putusan dan hambatan dalam penyelesaian sengketa secara komprehensif. Artikel ini mengkaji urgensi rekonstruksi penggabungan tuntutan berdasarkan pendekatan yuridis normatif dan studi perbandingan. Hasilnya menunjukkan perlunya penataan ulang norma yang memungkinkan fleksibilitas prosedural tanpa menghilangkan kejelasan batas kompetensi absolut.

Absolute jurisdiction is a fundamental element of Indonesia’s civil procedural law system, determining the types of cases under the authority of each judicial institution. In the context of religious courts, the boundaries of absolute jurisdiction often intersect with other materially related civil claims. The absence of explicit rules on cross-jurisdictional claim joinder has led to inconsistent rulings and hindered comprehensive dispute resolution. This article examines the urgency of reconstructing claim joinders using a normative legal and comparative approach. The findings highlight the need for procedural flexibility without undermining the clarity of absolute jurisdiction limits.
