Abstrak

The crime of petty theft seems to be a common habit in Indonesian society, regardless of the region and who the victim is. The crime of petty theft is never absent in society. Therefore, each region has its own problems in overcoming the crime of petty theft. As in this case, the crime of petty theft that has occurred for a long time in the Ngaso area until now the solution taken still cannot reduce the number of petty theft crimes. This thesis research aims to: first, to find out the understanding of the Ngaso village community regarding the crime of petty theft and its influence on law enforcement for the crime of petty theft in Ngaso village, Ujungbatu sub-district. Second, to find out the resolution of the crime of theft in Ngaso village, Ujungbatu sub-district. In writing this thesis, the author uses the sociological legal research method. The sociological legal research method is a legal research method that examines the applicable legal provisions and what happens in the reality of society, with the intention of finding facts that are used as research data which are then analyzed to identify what problems occur and ultimately lead to problem solving. The results of this thesis research can be concluded that the wrong understanding of the Ngaso village community regarding the crime of petty theft is a vital reason for the ineffectiveness of overcoming petty theft in the Ngaso village, understanding such as the community's assumption that theft with a victim's loss of less than 2.5 million cannot be reported to the police and cannot be processed criminally. Therefore, the community uses penal mediation as an alternative solution to overcome petty theft. However, this kind of solution has proven unable to reduce the number of petty thefts in the village because of the minimal deterrent effect on the perpetrators so that the perpetrators still have the intention to commit petty theft and what is certain is that the objectives of law enforcement are not achieved effectively, be it legal certainty, justice or benefits.
