PENEGAKAN HUKUM TERHADAP TINDAK PIDANA PERDAGANGAN HANDPHONE ILLEGAL DI KOTA PEKANBARU

Abstrak

Kemajuan teknologi dewasa ini, telah menempatkan handphone sebagai perangkat komunikasi yang sangat dibutuhkan dan dijadikan gaya hidup oleh sebagian besar masyarakat modern saat ini. Hal ini mengakibatkan angka perdagangan handphone illegal di Indonesia selalu meningkat tiap tahunnya, terkhusus di Kota Pekanbaru. Fenomena ini menjadi perhatian serius karena berdampak besar pada aspek sosial masyarakat dan tentunya ekonomi negara. Penelitian ini bertujuan untuk menganalisis penegakan hukum terhadap tindak pidana perdagangan handphone illegal di Pekanbaru, dengan fokus pada faktor-faktor yang menyebabkan naiknya angka perdagangan handphone tadi, hambatan yang dihadapi, dan solusi yang dapat diterapkan kedepannya. Penelitian ini menggunakan pendekatan yuridis-sosiologis di Kantor Bea Cukai Kota Pekanbaru dan Kepolisian Daerah Riau. Teknik pengumpulan data diperoleh melalui wawancara langsung dengan pihak terkait di Kepolisian Daerah Riau dan Bea Cukai Kota Pekanbaru, Kuesioner, dan kajian pustaka. Populasi dan sampel adalah keseluruhan pihak yang berkaitan dengan masalah yang diteliti. Populasi dan sampel dalam penelitian ini adalah Kanit subdit 1 Indagsi Ditreskrimsus Kepolisian Daerah Riau, Penyidik Subdit I Ditreskrimsus Kepolisian Daerah Riau, penyidik Bea Cukai Pekanbaru, Masyarakat kota Pekanbaru. Hasil penelitian menunjukkan bahwa baik Bea Cukai Kota Pekanbaru dan Kepolisian Daerah Riau telah melaksanakan penegakan hukum terhadap perdagangan handphone illegal ini baik secara preventif dan represif. Namun, efektivitas upaya tersebut masih terkendala oleh beberapa faktor seperti, faktor geografis Kota Pekanbaru, keterbatasan anggaran dan sumber daya manusia. Kurangnya kesadaran masyarakat terhadap dampak handphone illegal juga menjadi salah satu faktor signifikan yang mengurangi optimalisasi dalam penegakan hukum terhadap handphone illegal ini. Penelitian ini menyimpulkan bahwa untuk mengatasi masalah penegakan hukum terhadap perdagangan handphone illegal ini diperlukan langkah-langkah strategis mencakup peningkatan proses penyelidikan dan penyidikan dengan menambah jumlah pegawai, menambah sarana operasional, serta meningkatkan kompetensi SDM melalui pelatihan dan pengembangan kompetensi. Koordinasi dan kerjasama antara Kepolisian dan Bea Cukai juga perlu ditingkatkan. Selain itu, diperlukan juga sosialisasi dan edukasi kepada masyarakat secara bertahap dan menyeluruh untuk meningkatkan partisipasi masyarakat, kesadaran hukum, dan menciptakan budaya masyarakat yang taat hukum.

Today's technological advances have placed mobile phones as a communication device that is needed and used as a lifestyle by most modern societies today. This results in the number of illegal mobile phone trade in Indonesia always increasing every year, especially in the city of Pekanbaru. This phenomenon is a serious concern because it has a big impact on the social aspects of the community and of course the country's economy. This study aims to analyze law enforcement against the crime of illegal mobile phone trade in Pekanbaru, focusing on the factors that cause the increase in the number of mobile phone trade, the obstacles faced, and solutions that can be applied in the future. This study uses a juridical-sociological approach at the Pekanbaru City Customs Office and the Riau Regional Police. Data collection techniques were obtained through direct interviews with related parties at the Riau Regional Police and Pekanbaru City Customs, Questionnaires, and literature reviews. The population and sample are all parties related to the problem being studied. The population and sample in this study were the Head of Sub-Directorate 1 Indagsi Ditreskrimsus Riau Regional Police, Investigators of Sub-Directorate I Ditreskrimsus Riau Regional Police, Pekanbaru Customs investigators, and the Pekanbaru City community. The results of the study show that both the Pekanbaru City Customs and the Riau Regional Police have carried out law enforcement against this illegal mobile phone trade both preventively and repressively. However, the effectiveness of these efforts is still constrained by several factors such as the geographical factors of the city of Pekanbaru, budget limitations and human resources. The lack of public awareness of the impact of illegal mobile phones is also one of the significant factors that reduces the optimization in law enforcement against illegal mobile phones. This study concludes that to overcome the problem of law enforcement against the illegal mobile phone trade, strategic steps are needed including improving the investigation and investigation process by increasing the number of employees, increasing operational facilities, and improving human resource competence through training and competency development. Coordination and cooperation between the Police and Customs also need to be improved. In addition, socialization and education to the community are also needed gradually and comprehensively to increase community participation, legal awareness, and create a culture of law-abiding society.
