PENYELESAIAN PERKARA DESERSI DI LINGKUNGAN MILITER DENGAN PENERAPAN DISPLIN MILITER DAN RESTORATIVE JUSTICE

Peradilan militer berperan penting dalam menegakkan hukum dan menjaga kedisiplinan prajurit di lingkungan Tentara Nasional Indonesia (TNI). Salah satu pelanggaran yang sering terjadi adalah tindak pidana desersi, yaitu tindakan anggota militer yang meninggalkan kesatuan tanpa izin dalam jangka waktu tertentu sebagaimana diatur dalam KUHPM. Selama ini, penyelesaian perkara desersi cenderung berorientasi pada pendekatan retributif, yang menekankan hukuman semata. Penelitian ini bertujuan untuk menganalisis kemungkinan penerapan restorative justice dalam penyelesaian perkara desersi sebagai alternatif hukum yang lebih manusiawi namun tetap selaras dengan disiplin militer. Melalui pendekatan yuridis normatif, penelitian ini menelaah dasar hukum, mekanisme penyelesaian, serta relevansi penerapan keadilan restoratif dalam sistem peradilan militer. Hasil penelitian menunjukkan bahwa penerapan restorative justice berpotensi meningkatkan efektivitas pembinaan prajurit dan menjaga kehormatan institusi militer tanpa mengurangi wibawa hukum.
The military judiciary plays an important role in enforcing the law and maintaining the discipline of soldiers within the Indonesian National Army (TNI). One of the violations that often occurs is the crime of desertion, which is the act of military members who leave the unit without permission within a certain period of time as stipulated in the Criminal Code. So far, the settlement of desertion cases has tended to be oriented towards a retributive approach, which emphasizes punishment alone. This study aims to analyze the possibility of applying restorative justice in the settlement of desertion cases as a more humane legal alternative but still in harmony with military discipline. Through a normative juridical approach, this study examines the legal basis, settlement mechanism, and relevance of the application of restorative justice in the military justice system. The results of the study show that the application of restorative justice has the potential to increase the effectiveness of soldier training and maintain the honor of military institutions without reducing the authority of the law.
