PENERAPAN RESTORATIVE JUSTICE SEBAGAI SOLUSI DALAM KASUS TINDAK PIDANA PENGANIAYAAN STUDI KASUS PADA KEJARI SAMOSIR

Abstrak

Penelitian ini menginvestigasi upaya implementasi Keadilan Restoratif untuk penanganan tindak pidana penganiayaan di Kejaksaan Negeri Samosir. Tujuan utamanya ialah untuk memahami bagaimana KR diimplementasikan, apa saja kendala yang dihadapi oleh jaksa, dan solusi apa yang dapat diterapkan. Dengan menggunakan metode yuridis sosiologis, penelitian ini menganalisis peraturan hukum terkait dan efektivitasnya pada masyarakat. Hasil penelitian telah mengungkapkan Kejaksaan Negeri Samosir telah berupaya menerapkan KR sesuai peraturan, namun masih menghadapi tantangan, terutama kurangnya kepercayaan masyarakat terhadap mekanisme ini. Oleh karena itu, disarankan agar dilakukan sosialisasi yang lebih intensif kepada masyarakat mengenai KR.

This research investigates the implementation of Restorative Justice is handling acts of persecution at a Samosir District Attorney's Office. The main objectives are to understand how RJ is implemented, identify the challenges faced by prosecutors, and determine potential solutions. Employing a socio-legal approach, this research analyzes the relevant legal regulations and their effectiveness in the community. The findings reveal that while a Samosir District Attorney's Office has strived to implement RJ in accordance with existing regulations, it still encounters challenges, primarily a lack of public trust in this mechanism. Therefore, it is recommended that more intensive socialization efforts be conducted to educate the public about RJ.
