TANGGUNG JAWAB SOSIAL DAN HUKUM PERUSAHAAN SAWIT TERHADAP PEMULIHAN LAHAN BERMASALAH DI INDONESIA PASCA PENERTIBAN OLEH PEMERINTAH

Abstrak

Penelitian ini membahas tanggung jawab sosial dan hukum perusahaan sawit terhadap pemulihan lahan bermasalah pasca penertiban oleh pemerintah berdasarkan Peraturan Pemerintah Nomor 45 tahun 2025. Penelitian ini menggunakan metode hukum normatif dengan pendekatan perundang-undangan dan konseptual untuk menganalisis kewajiban hukum dan pelaksanaan Tanggung Jawab Sosial dan Lingkungan (TJSL) oleh perusahaan sawit. Hasil penelitian ini menunjukkan bahwa perusahaan sawit wajib mematuhi ketentuan izin HGU dan IUP serta melaksanakan TJSL sebagai bentuk pemulihan ekologis. Namun, implementasi TJSL masih bersifat formalitas dan belum terarah pada pemulihan lingkungan secara nyata. Hambatan utama meliputi ketidakjelasan pembagian tanggung jawab antara pemerintah dan korporasi serta lemahnya pengawasan terhadap pelaksanaan TJSL. Penelitian ini menegaskan pentingnya standar nasional TJSL dan penerapan prinsip polluter pays untuk mewujudkan akuntabilitas korporasi dan keberlanjutan lingkungan.

This study discusses the social and legal responsibilities of palm oil companies towards the restoration of problematic land after government enforcement based on Government Regulation No. 45 of 2025. This study uses a normatfve legal method with a legislative and conceptual approach to analyze the legal obligations and implementation of Social and Environmental Responsibility (SER) by palm oil companies. The results show that palm oil companies are required to comply with HGU and IUP permit provisions and implement SREL as a form of ecological restoration. However, the implementation of SREL is still a formality and has not yet been directed towards real environmental restoration. The main obstacles include the unclear division of responsibilities between the government and corporations and weak supervision of SREL implementation. This study emphasizes the importance of national SREL standards and the application of the polluter pays principle to achieve corporate accountability and environmental sustainability.
