DUALISME UPAYA HUKUM ADMINISTRATIF PENYELESAIAN SENGKETA PAJAK

Pasal 25 dan Pasal 36 ayat (1) huruf b Undang-Undang Ketentuan Umum dan Tata Cara Perpajakan (UU KUP) sama-sama dapat dipakai untuk mengoreksi Surat Ketetapan Pajak (SKP), tetapi keduanya berpijak pada rezim kewenangan yang berbeda. Keberatan pada Pasal 25 bersifat kewenangan terikat, sedangkan permohonan pada Pasal 36 ayat (1) huruf b bersifat kewenangan diskresioner, sehingga banding membuka pemeriksaan materiil penuh sementara gugatan hanya membuka pemeriksaan terbatas. Artikel ini menjawab tiga persoalan, yaitu penyebab dualisme tersebut, implikasinya terhadap kepastian hukum dan keadilan prosedural Wajib Pajak, serta rekonstruksi normatif yang diperlukan. Penelitian memakai metode hukum normatif yang bersifat preskriptif-analitis, dengan pendekatan perundang-undangan, konseptual, dan kasus. Hasil penelitian menunjukkan bahwa dualisme bersumber dari lima faktor struktural, yaitu kesamaan objek koreksi, ambiguitas frasa “SKP yang tidak benar”, kesalahan penempatan koreksi materiil dalam rezim diskresioner, inkonsistensi internal Pasal 36, dan desain konsekuensial yang tidak sinkron antara banding dan gugatan. Kelima faktor itu menimbulkan fragmentasi perlindungan hukum, ketidakpastian pemilihan jalur, ketidaksetaraan akses pemeriksaan materiil, dan procedural entrapment, yaitu kondisi ketika Wajib Pajak kehilangan akses pemeriksaan materiil bukan karena lemahnya dalil, melainkan karena desain prosedur itu sendiri. Artikel ini merekomendasikan rekonstruksi normatif yang menempatkan koreksi kebenaran materiil SKP dalam rezim kewenangan terikat, baik lewat integrasi ke Pasal 25 disertai penghapusan Pasal 36 ayat (1) huruf b, maupun lewat pembentukan mekanisme koreksi materiil tersendiri.
Article 25 and Article 36 paragraph (1) letter b of the General Provisions and Tax Procedures Law (UU KUP) can both be used to correct a Tax Assessment Letter (SKP), yet they rest on different authority regimes. An objection under Article 25 is a bound authority, while an application under Article 36 paragraph (1) letter b is a discretionary one, so an appeal opens a full material review while a lawsuit only allows a limited one. This article addresses three questions, namely the causes of this dualism, its implications for taxpayers’ legal certainty and procedural justice, and the normative reconstruction it requires. The study applies a prescriptive-analytical normative legal method, using statutory, conceptual, and case-based approaches. The findings show that the dualism stems from five structural factors, namely the shared correction object, the ambiguity of the phrase “an incorrect SKP,” the misplacement of material correction within a discretionary regime, internal inconsistency in Article 36, and an unsynchronized consequential design between appeals and lawsuits. These factors produce fragmented legal protection, uncertainty in choosing a legal avenue, unequal access to material review, and procedural entrapment, a condition in which taxpayers lose access to material review not because their claims are weak, but because the procedural design itself forecloses that access. The article recommends a normative reconstruction that places material correction of the SKP within a bound-authority regime, either by integrating it into Article 25 while repealing Article 36 paragraph (1) letter b, or by creating a separate material-correction mechanism.
