KEHADIRAN NOTARIS DALAM PROSES PERADILAN PERKARA PIDANA SEBAGAI UPAYA PENEGAKKAN HUKUM DAN KEADILAN DI INDONESIA

Abstrak

Notaris adalah pejabat umum yang berwenang untuk membuat akta otentik dan memiliki
kewenangan untuk membuat akta otentik, sebagaimana diatur dalam Undang-Undang tersebut di atas atau
berdasarkan Undang-Undang lainnya. Dalam menjalankan tugas dan kewajiban Notaris, Notaris mendapatkan
perlindungan hukum sebagaimana tercantum dalam Pasal 66 Ayat 1 Undang-Undang Nomor 2 Tahun 2014
Tentang Perubahan atas Undang-Undang Nomor 30 Tahun 2004 tentang Jabatan Notaris. Namun, dalam
Putusan Mahkamah Konstitusi No. 16/PUU XVIII/2020, Notaris disebutkan sebagai pihak yang digugat oleh
PJI, dengan prinsip yang mendasari bahwa Notaris tidak memiliki kedudukan hukum (legal standing). Alasan
permohonan pengujian tersebut berawal dari terkendalanya proses penyidikan oleh penyidik sehubungan
dengan memberikan keterangan palsu kedalam akta otentik. Saat itu Majelis Kehormatan Notaris tidak
memberikan ijin kepada penyidik untuk memeriksa notaris, sehingga penyidik terkendala untuk melanjutkan
proses penyidikan. Isu hukum yang diangkat dalam penelitian ini adalah Urgensi kehadiran notaris dalam
proses peradilan perkara pidana sebagai upaya penegakkan hukum dan keadilan di Indonesia.

A notary is a public official who is authorized to make authentic deeds and has the
authority to make authentic deeds, as regulated in the Law above or based on other Laws. In
carrying out the duties and obligations of a Notary, the Notary receives legal protection as stated in
Article 66 Paragraph 1 of Law Number 2 of 2014 concerning Amendments to Law Number 30 of
2004 concerning the Position of Notary. However, in the Constitutional Court Decision no. 16/PUU
The reason for the request for testing stems from obstacles in the investigation process by
investigators in connection with providing false information in authentic deeds. At that time, the
Notary Honorary Council did not give permission to investigators to examine the notary, so
investigators were hampered in continuing the investigation process. The legal issues raised in this
research are the urgency of the presence of a notary in the criminal justice process as an effort to
enforce law and justice in Indonesia.
