KEDUDUKAN CRYPTOCURRENCY SEBAGAI OBJEK PENYITAAN DALAM UPAYA PEMULIHAN KERUGIAN NEGARA AKIBAT TINDAK PIDANA PENCUCIAN UANG

Perkembangan teknologi finansial telah melahirkan instrumen baru berupa cryptocurrency yang rawan disalahgunakan sebagai sarana tindak pidana pencucian uang (TPPU). Karakteristik cryptocurrency yang terdesentralisasi, pseudonim, dan lintas yurisdiksi menimbulkan tantangan tersendiri bagi aparat penegak hukum dalam melakukan penyitaan sebagai upaya pemulihan kerugian negara. Penelitian ini bertujuan untuk menganalisis kedudukan hukum cryptocurrency sebagai objek penyitaan dalam tindak pidana pencucian uang berdasarkan sistem hukum pidana Indonesia serta menguraikan mekanisme penyitaannya sebagai upaya pemulihan kerugian negara. Metode yang digunakan adalah penelitian hukum normatif dengan pendekatan perundang-undangan dan pendekatan konseptual. Hasil penelitian menunjukkan bahwa cryptocurrency dapat dikategorikan sebagai benda tidak berwujud yang dapat disita berdasarkan. Pasal 1 angka 35 jo. pasal 123 ayat (1) KUHAP serta Pasal 71 dan Pasal 77 Undang-Undang Nomor 8 Tahun 2010 tentang TPPU, namun pengaturan tersebut belum secara eksplisit menjangkau karakteristik teknis aset kripto, khususnya yang tersimpan dalam cold wallet. Mekanisme penyitaan memerlukan kerja sama lintas lembaga antara penyidik, Otoritas Jasa Keuangan, dan penyelenggara perdagangan aset kripto, serta didukung oleh pengesahan Rancangan Undang-Undang Perampasan Aset guna mengoptimalkan pemulihan kerugian negara. Penelitian ini menyimpulkan perlunya pembaruan hukum acara pidana yang responsif terhadap perkembangan aset digital.
The development of financial technology has given rise to a new instrument, cryptocurrency, which is vulnerable to misuse as a means of money laundering. The decentralized, pseudonymous, and cross-jurisdictional nature of cryptocurrency poses distinct challenges for law enforcement officials in carrying out seizure as an effort to recover state losses. This study aims to analyze the legal standing of cryptocurrency as an object of seizure in money laundering crimes under Indonesia's criminal law system and to describe its seizure mechanism as an effort to recover state losses. The method used is normative legal research employing statutory and conceptual approaches. The results show that cryptocurrency may be categorized as intangible property subject to seizure under Article 1 number 35 and. article 123 paragraph (1) of the Penal Code, as well as Articles 71 and 77 of Law Number 8 of 2010 on Money Laundering, although these provisions do not yet explicitly address the technical characteristics of crypto assets, particularly those stored in cold wallets. The seizure mechanism requires cross-institutional cooperation among investigators, the Financial Services Authority, and crypto asset trading operators, and should be supported by the enactment of the Asset Forfeiture Bill to optimize the recovery of state losses. This study concludes that a reform of criminal procedure law responsive to the development of digital assets is necessary.
