Abstrak

Penelitian ini bertujuan untuk menganalisis secara yuridis tindak pidana kekerasan psikis terhadap istri dalam lingkup rumah tangga berdasarkan ketentuan dalam Undang-Undang Nomor 23 Tahun 2004 tentang Penghapusan Kekerasan dalam Rumah Tangga (UU PKDRT). Kekerasan psikis, yang mencakup ancaman, intimidasi, penghinaan, serta tindakan yang menimbulkan tekanan mental dan emosional, merupakan bentuk kekerasan yang memiliki dampak serius terhadap integritas psikologis korban, namun sering kali diabaikan karena kesulitan pembuktian secara hukum. Kekerasan psikis merupakan bentuk kekerasan non-fisik yang berdampak serius terhadap kondisi mental, emosional, dan sosial korban, namun sering kali sulit dibuktikan secara hukum. Tujuan dari penelitian ini adalah untuk mengkaji bagaimana bentuk kekerasan psikis dikonstruksikan secara hukum, bagaimana penerapan pasal-pasal dalam UU PKDRT terkait kekerasan psikis, serta sejauh mana perlindungan hukum diberikan kepada korban, khususnya istri sebagai pihak yang paling rentan. Metode yang digunakan adalah metode penelitian hukum normatif dengan pendekatan perundang-undangan dan studi kasus. Hasil penelitian menunjukkan bahwa meskipun UU PKDRT telah mengatur secara eksplisit mengenai kekerasan psikis (khususnya dalam Pasal 5 huruf b, Pasal 7 dan Pasal 45), masih terdapat kendala dalam penegakan hukum, baik dalam pembuktian, pemahaman aparat penegak hukum, maupun ketersediaan layanan perlindungan korban. Oleh karena itu, perlu penguatan dalam aspek penerapan hukum, pelatihan aparat, serta peningkatan akses korban terhadap bantuan hukum dan psikologis.

This research aims to conduct a juridical analysis of the criminal act of psychological violence against wives within the household sphere, based on the provisions of Law Number 23 of 2004 concerning the Elimination of Domestic Violence (UU PKDRT). Psychological violence which includes threats, intimidation, verbal abuse, and actions causing mental and emotional distress is a form of abuse that significantly affects the psychological integrity of victims. However, it is often overlooked due to the difficulty of legal proof. As a non-physical form of violence, psychological abuse has serious impacts on the mental, emotional, and social well-being of victims, yet is frequently under-addressed in legal proceedings. The objective of this study is to examine how psychological violence is legally constructed, how the relevant provisions of the UU PKDRT are applied, and to what extent legal protection is afforded to victims, particularly wives as the most vulnerable party. This study employs a normative legal research method with a statutory and case study approach. The findings reveal that although the UU PKDRT explicitly regulates psychological violence (notably in Article 5 letter b, Article 7, and Article 45), there remain significant challenges in law enforcement, including evidentiary difficulties, limited understanding among law enforcement officers, and inadequate victim protection services. Therefore, it is necessary to strengthen the implementation of legal provisions, enhance the training of law enforcement personnel, and improve victims' access to legal and psychological assistance.
