PERLINDUNGAN HUKUM TERHADAP KORBAN KEKERASAN OLEH APARAT KEPOLISIAN DALAM AKSI DEMONSTRASI

Abstrak

Di bawah bimbingan La Syarifuddin dan Herdiansyah Hamzah. Penelitian ini mengkaji mengenai perlindungan hukum terhadap korban kekerasan oleh aparat kepolisian pada aksi demonstrasi di Kota Samarinda, studi ini mengkaji implementasi perlindungan hukum korban serta bagaimana penerapan Standar Operasional Prosedur pengamanan saat demonstrasi oleh aparat kepolisian. Pendekatan penelitian menggunakan pendekatan social legal dengan metode normatif, meliputi pendekatan perundang-undangan (statute approach), pendekatan kasus (case approach). Penelitian ini mengkaji peraturan perundang-undangan, hasil wawancara dengan pihak Kepolisian Resor Kota Samarinda, Lembaga Bantuan Hukum kota Samarinda, serta putusan hakim. Data dianalisis secara kualitatif untuk menjawab rumusan masalah dan tujuan penelitian, yaitu bentuk kekerasan yang dilakukan oleh aparat kepolisian saat demonstrasi serta implementasi dan efektivitas perlindungan hukum terhadap korban kekerasan saat aksi demonstrasi di Kota Samarinda. Hasil penelitian menunjukkan bahwa perlindungan hukum dan efektivitas pertanggungjawaban pidana terhadap kasus represif saat demonstrasi masih sangat rendah terutama dalam upaya pertanggungjawaban pelaku. Selain itu penelitian ini juga menganalisis sejauh mana efektivitas perlindungan hukum terhadap korban represif di Kota Samarinda. Pelaksanaan pengamanan aksi demonstrasi di Kota Samarinda masih diwarnai dengan tindakan kekerasan yang dilakukan oleh aparat kepolisian terhadap demonstran baik dalam bentuk kekerasan fisik maupun nonfisik. Tindakan tersebut menimbulkan korban dan melanggar prinsip penggunaan kekuatan secara proporsional serta standar hak asasi manusia.

Supervised by La Syarifuddin and Herdiansyah Hamzah This study examines legal protection for victims of violence committed by police officers during demonstrations in Samarinda City. It analyzes the implementation of legal protection for victims as well as the application of Standard Operating Procedures (SOP) for securing demonstrations by police officers. The research uses a socio-legal approach with normative methods, including statutory and case approaches. The study reviews laws and regulations, interview results with the Samarinda City Police Resort, the Samarinda Legal Aid Institute, and court decisions. Data were analyzed qualitatively to address the research problems and objectives, namely identifying the forms of violence committed by police officers during demonstrations and assessing the implementation and effectiveness of legal protection for victims of such violence in Samarinda City. The results show that legal protection and the effectiveness of criminal accountability in cases of repressive actions during demonstrations remain very low, particularly in efforts to hold perpetrators accountable. In addition, this study analyzes the extent of the effectiveness of legal protection for victims of repressive actions in Samarinda City. The implementation of demonstration security in Samarinda is still marked by acts of violence committed by police officers against demonstrators, both in the form of physical and non-physical violence. These actions result in victims and violate the principle of proportional use of force as well as human rights standards
