ANALISIS YURIDIS IZIN USAHA PERTAMBANGAN : STUDI KASUS PT.MANTIMIN COAL MINING NOMOR PERKARA 241/G/LH/2018/PTUN.JKT

Abstrak

Penelitian ini menganalisis aspek yuridis normatif penerbitan Izin Usaha Pertambangan dan penyelesaian sengketa administratif melalui studi kasus PT Mantimin Coal Mining (PT MCM). Menggunakan metode penelitian hukum normatif dengan pendekatan perundang-undangan dan kasus, penelitian ini mengkaji Putusan PTUN Jakarta No.241/G/LH/2018/PTUN.JKT. Hasil penelitian menunjukkan bahwa penerbitan WIUPK PT MCM mengandung cacat prosedural karena tidak memenuhi persyaratan kajian lingkungan dan partisipasi masyarakat. PTUN Jakarta membatalkan SK Menteri ESDM No.1802 K/30/MEM/2018 berdasarkan pertimbangan pelanggaran prosedur administratif dan prinsip perlindungan lingkungan. Putusan ini menjadi preseden penting dalam penguatan aspek lingkungan dalam perizinan pertambangan di Indonesia.

This research aims to analyze the role and impact of the Jambi Malay ulama network on the development of Islam in the region in the 19th to 20th centuries. By applying qualitative descriptive methods and a literature review approach, this study investigates the contribution of Jambi Malay ulama in transferring Islamic knowledge, building educational institutions, shaping religious thought, and influencing social and cultural aspects of local communities. The research results show that the Jambi Malay ulama network plays an important role in adapting and integrating Islamic teachings with local traditions and wisdom, thereby creating the unique characteristics of Malay Islam in Jambi. This acculturation process reflects the open attitude of the Jambi Malay community in accepting Islamic teachings while still maintaining their cultural identity. This research provides in-depth insight into the dynamics of Islamic development in the archipelago and highlights the important role of local ulama in shaping the unique Islamic landscape in Indonesia.
