PERBEDAAN DAN PERSAMAAN DENGAN FILSAFAT DAN FILSAFAT HUKUM

Penelitian ini membahas filsafat hukum dan filsafat hukum Islam sebagai landasan konseptual dalam memahami hakikat hukum serta arah penetapan hukum yang berorientasi pada kemaslahatan umum. Kajian ini bertujuan untuk menganalisis pengertian filsafat, filsafat hukum, dan filsafat hukum Islam, menjelaskan hubungan ketiganya dalam pembentukan sistem hukum, serta mengkaji tujuan hukum berdasarkan perspektif pemikiran para ahli dan prinsip-prinsip hukum Islam. Penelitian menggunakan metode penelitian hukum normatif dengan pendekatan kualitatif melalui studi pustaka (library research). Data diperoleh dari berbagai sumber sekunder berupa buku, jurnal ilmiah, peraturan perundang-undangan, dan literatur yang relevan, kemudian dianalisis secara deskriptif-analitis melalui proses reduksi, interpretasi, dan penarikan kesimpulan. Hasil penelitian menunjukkan bahwa filsafat hukum berfungsi sebagai dasar reflektif dalam memahami hakikat, tujuan, dan kekuatan mengikat hukum, sedangkan filsafat hukum Islam menempatkan Al-Qur'an dan Sunnah sebagai sumber utama hukum yang diarahkan untuk mewujudkan keadilan, kepastian hukum, kemanfaatan, serta kemaslahatan masyarakat. Penelitian ini juga menemukan bahwa hukum yang ideal tidak hanya berorientasi pada kepastian normatif, tetapi harus mampu mengakomodasi nilai-nilai moral, etika, dan keadilan yang hidup dalam masyarakat. Dengan demikian, filsafat hukum dan filsafat hukum Islam memiliki peran strategis dalam membangun sistem hukum yang responsif terhadap perkembangan sosial tanpa mengabaikan nilai-nilai fundamental yang menjadi dasar pembentukan hukum.
This study examines the philosophy of law and the philosophy of Islamic law as conceptual foundations for understanding the nature of law and the direction of legal formulation aimed at achieving public welfare (maslahah). The study seeks to analyze the concepts of philosophy, philosophy of law, and philosophy of Islamic law, explain the interrelationship among these disciplines in the development of legal systems, and examine the objectives of law from the perspectives of legal philosophers and the fundamental principles of Islamic law. This research employs a normative legal research method with a qualitative approach through library research. The data were collected from secondary sources, including books, scholarly journals, legislation, and other relevant legal literature, and were analyzed using a descriptive-analytical method through data reduction, interpretation, and conclusion drawing. The findings indicate that the philosophy of law serves as a reflective foundation for understanding the nature, objectives, and binding force of law, while the philosophy of Islamic law recognizes the Qur'an and the Sunnah as the primary sources of law directed toward achieving justice, legal certainty, utility, and public welfare. Furthermore, the study reveals that an ideal legal system should not merely emphasize normative legal certainty but must also accommodate moral values, ethical principles, and the sense of justice that develops within society. Therefore, both the philosophy of law and the philosophy of Islamic law play a strategic role in establishing a legal system that is responsive to social change while maintaining the fundamental values that underpin legal development.
