Abstrak

Penelitian ini mengkaji perlindungan hukum bagi pekerja wanita Indonesia di luar negeri (TKWI) sebagai korban pelecehan seksual. Dengan pendekatan yuridis normatif, penelitian ini menelaah norma hukum nasional, seperti UU Perlindungan Pekerja Migran Indonesia dan UU TPKS, serta instrumen internasional, antara lain Konvensi ILO Nomor 189 dan 190. Temuan menunjukkan bahwa meskipun kerangka hukum sudah tersedia, implementasinya masih lemah karena minimnya koordinasi lembaga, dukungan diplomatik, dan mekanisme pelaporan-pemulihan. Penelitian ini mengusulkan strategis kebijakan berbasis IFRAC, termasuk pengembangan platform digital pemantau pekerja, serta amandemen undang-undang untuk menegakkan hukuman pidana berat dan mekanisme pemulangan darurat bagi korban pelecehan seksual.

This study examines the legal protection of Indonesian female migrant workers who suffer sexual harassment. Using a normative-juridical approach, it analyzes domestic laws such as Migrant Workers Protection Law and the Sexual Violence Law, as well as international instrument, including ILO Convention No. 189 and 190. The findings indicate that, although the legal framework exists, its implementation is weak due to limited inter-institutional coordination, inadequate diplomatic support, and insufficient reporting and recovery mechanisms. The study proposes an IFRAC-based policy strategy, including the establishment of a Women Migrant Protection Task Force, the strengthening of bilateral agreements, a digital worker-monitoring platform, and legislative amendments to enforce stricter criminal sanctions and emergency repatriation procedures for sexual harassment victims.
