PELAKSANAAN RESTORATIVE JUSTICE TINDAK PIDANA PEMINDAHTANGANAN OBJEK JAMINAN FIDUSIA PADA TINGKAT PENYIDIK KEPOLISIAN

Abstrak

Restorative justice merupakan salah satu alternative penyelesaian yang dinilai dapat menurunkan angka tindak pidana pemindahtanganan objek jaminan fidusia. Ada banyak kasus pemindahtanganan objek jaminan fidusia yang terjadi di Indonesia. Dengan ada regulasi terkait penerapan restorative justice dalam penyelesaian perkara pidana dinilai dapat mengurangi penumpukan perkara pemindahtanganan objek jaminan fidusia yang ada. Dalam penelitian ini yang menjadi pokok pembahasan adalah bagaimana pelaksanaan restorative justice tindak pidana pemindahtanganan objek jaminan fidusia pada tingkat penyidik kepolisian. Penelitian ini bertujuan melihat penyidik kepolisian melaksanakan restorative justice dalam tindak pidana pemindahtanganan objek jaminan fidusia. Dalam penelitian ini dapat disimpulkan bahwa 1) Konsep restorative justice pada tindak pidana pemindahtanganan objek jaminan fidusia menjadikan penyelesaian perkara pidana menjadi sederhana dan lugas; 2) Dalam pelaksanaaan restorative justice pada tindak pidana pemindahtanganan objek jaminan fidusia, peran penyidik hanya sebagai fasilitator serta mediator dan semua keputusan diserahkan kepada para pihak; dan 3) Strategi yang dilakukan para penyidik untuk menunjang keberhasilan pelaksanaan restorative justice pada tindak pidana pemindahtanganan objek jaminan fidusia juga harus sesuai dengan teori perlindungan korban dan tetap menjunjung tinggi perlindungan hukum terhadap pelaku.

Restorative justice is an alternative solution which is considered to be able to reduce the number of criminal acts of alienating fiduciary objects. There are many cases of transfer of fiduciary collateral objects that occur in Indonesia. By having regulations related to the application of restorative justice in resolving criminal cases, it is considered that it can reduce the buildup of cases regarding the transfer of existing fiduciary collateral objects. In this research, the main topic of discussion is how restorative justice is implemented in the criminal act of alienating the object of fiduciary guarantees at the police investigator level. This research aims to see police investigators implementing restorative justice in criminal acts of alienating fiduciary objects. In this research it can be concluded that 1) The concept of restorative justice in the criminal act of alienating the object of fiduciary guarantees makes the resolution of criminal cases simple and straightforward; 2) In implementing restorative justice in the criminal act of alienating fiduciary objects, the investigator's role is only as a facilitator and mediator and all decisions are left to the parties; and 3) The strategies carried out by investigators to support the successful implementation of restorative justice in criminal acts of alienating fiduciary collateral objects must also be in accordance with the theory of victim protection and still uphold legal protection for perpetrators.
