Abstrak

Indonesia adalah negara hukum, sehingga setiap tindakan warga harus sesuai aturan dan norma yang berlaku. Hukum berperan penting dalam mengatur perilaku masyarakat. Tanpa hukum, tatanan negara akan kacau. Saat ini, tindak kriminal terus meningkat dengan cara dan alat yang semakin modern, sehingga makin meresahkan masyarakat. Penelitian ini bertujuan untuk mengetahui bagaimana perlindungan hukum terhadap perempuan disabilitas sebagi korban kekerasan seksual di Indonesia khusunya di Kabupaten Rejang Lebong Oleh Kepolisian, karena dapat menimbulkan keresahan terhadap masyarakat dan orang tua serta ketentraman masyarakat.serta mengidentifikasi hambatan yang dihadapi dalam pelaksanaannya. Metode penelitian yang digunakan adalah hukum empiris (socio-legal) dengan pendekatan deskriptif. Polres Rejang Lebong melalui Unit PPA telah berupaya memberikan perlindungan hukum bagi perempuan penyandang disabilitas yang menjadi korban kekerasan seksual. Upaya preventif dilakukan lewat sosialisasi di sekolah dan masyarakat, guna meningkatkan pemahaman tentang kekerasan seksual dan hak korban difabel. Upaya represif dilakukan melalui proses penyidikan dan pendampingan selama proses hukum.Namun, pelaksanaan belum maksimal karena keterbatasan fasilitas dan tenaga terlatih.Minimnya laporan dari korban juga menjadi hambatan, akibat rasa malu dan tekanan sosial.Fasilitas ramah disabilitas dan pemahaman aparat masih perlu ditingkatkan.Dibutuhkan kerja sama antara kepolisian, UPTD PPA, DPPPA, dan lembaga pendamping.Agar perlindungan hukum berjalan efektif dan korban mendapat keadilan yang layak.

Indonesia is a state based on the rule of law, where every citizen's actions must conform to the prevailing rules and norms. Law plays a vital role in regulating societal behavior. Without law, the order of the nation would collapse. Today, criminal acts are increasing in both number and sophistication, causing growing public concern. This research aims to examine the legal protection afforded to women with disabilities who are victims of sexual violence in Indonesia, particularly in Rejang Lebong Regency by the Police, as such crimes cause unrest among communities, parents, and disrupt public peace. The study also seeks to identify the challenges faced in its implementation. This research uses an empirical legal method (socio-legal approach) with a descriptive approach. The Rejang Lebong Police, through its Women and Children Protection Unit (Unit PPA), have made efforts to provide legal protection for women with disabilities who are victims of sexual violence. Preventive measures include conducting socialization and awareness campaigns in schools and local communities to increase understanding of sexual violence and the rights of persons with disabilities. Repressive efforts are carried out through investigations and legal proceedings, with support and assistance provided to the victims throughout the legal process.However, the implementation of these efforts remains suboptimal due to limited accessible facilities and a lack of trained personnel. Additionally, underreporting by victims—caused by shame and social pressure—presents a significant obstacle. Disability-friendly facilities and officers’ understanding of the needs of disabled victims need to be improved. Therefore, strong collaboration between the police, UPTD PPA, DPPPA, and legal aid institutions is necessary to ensure that legal protection is carried out effectively and that victims receive the justice they deserve.
