PEMBUKAAN RAHASIA BANK DALAM PROSES PEWARISAN: ANALISIS PUTUSAN PENGADILAN NEGERI DEPOK NOMOR 21/PDT.P/2023

Abstrak

Penelitian ini membahas problematika pembukaan rahasia bank dalam konteks pewarisan dengan studi kasus Putusan Pengadilan Negeri Depok Nomor 21/Pdt.P/2023/PN.Dpk. Permasalahan yang diangkat adalah konflik normatif antara prinsip kerahasiaan bank sebagaimana diatur dalam Pasal 40 Undang-Undang Perbankan dengan hak ahli waris untuk menguasai harta peninggalan berdasarkan Pasal 44 ayat (2) Undang-Undang Perbankan serta ketentuan Kitab Undang-Undang Hukum Perdata. Penelitian ini menggunakan metode yuridis normatif dengan pendekatan statute dan case approach. Hasil analisis menunjukkan bahwa rahasia bank di Indonesia menganut prinsip relative secrecy yang memungkinkan adanya pengecualian, salah satunya untuk kepentingan pewarisan. Putusan PN Depok memberikan legitimasi yuridis kepada ahli waris untuk mencairkan simpanan pewaris, sehingga menunjukkan peran pengadilan dalam menyeimbangkan perlindungan rahasia bank dengan kepastian hukum hak waris.

This study examines the issue of bank secrecy disclosure in the context of inheritance, with a case study of the Decision of the Depok District Court Number 21/Pdt.P/2023/PN.Dpk. The main problem addressed is the normative conflict between the principle of bank secrecy as regulated in Article 40 of the Banking Law and the heirs’ right to inherit the estate under Article 44 paragraph (2) of the Banking Law as well as the provisions of the Indonesian Civil Code. This research employs a normative juridical method with a statute and case approach. The findings show that bank secrecy in Indonesia adheres to the principle of relative secrecy, which allows for certain exceptions, one of which is for inheritance purposes. The decision of the Depok District Court provides legal legitimacy for the heirs to withdraw the depositor’s savings, thereby demonstrating the role of the court in balancing the protection of bank secrecy with the legal certainty of inheritance rights.
