ANALISIS IMPLEMENTASI RESTORATIVE JUSTICE BERBASIS PERATURAN JAKSA AGUNG NO. 15 TAHUN 2020 DALAM PENANGANAN PERKARA PENGANIAYAAN RINGAN DI KABUPATEN SAMOSIR

Abstrak

Penelitian ini menganalisis efektivitas implementasi Restorative Justice berdasarkan PerJa No. 15 Tahun 2020 dalam penanganan perkara penganiayaan ringan di Kejaksaan Negeri Samosir. Penelitian ini menggunakan pendekatan hukum normatif doktrinal yang dikombinasikan dengan analisis empiris. Data primer diperoleh melalui wawancara mendalam dengan jaksa penuntut umum dan studi dokumen perkara, sedangkan data sekunder meliputi analisis peraturan perundang-undangan dan literatur akademik. Hasil penelitian menunjukkan bahwa implementasi RJ berjalan melalui tiga tahap sistematis: identifikasi kelayakan perkara, fasilitasi musyawarah, dan pengawasan pasca-mediasi. Temuan utama mengungkapkan bahwa pendekatan ini berhasil menciptakan efisiensi proses hukum dengan rata- rata penyelesaian 17 hari kerja, mewujudkan keadilan restoratif yang berorientasi pemulihan, serta memperkuat legitimasi sosial kejaksaan melalui integrasi nilai-nilai kearifan lokal Dalihan Na Tolu. Penelitian menyimpulkan bahwa meskipun RJ telah menunjukkan dampak transformatif dalam sistem peradilan pidana, optimalisasi implementasinya memerlukan pengembangan standar operasional prosedur yang lebih komprehensif, peningkatan kapasitas fasilitator, dan penguatan jejaring kolaborasi dengan pemangku kepentingan lokal.

This study analyzes the effectiveness of the implementation of Restorative Justice based on PerJa No. 15 of 2020 in handling minor assault cases at the Samosir District Attorney's Office. This study uses a normative doctrinal legal approach combined with empirical analysis. Primary data was obtained through in-depth interviews with public prosecutors and case document studies, while secondary data included analysis of legislation and academic literature. The results of the study show that the implementation of RJ goes through three systematic stages: case eligibility identification, facilitation of deliberation, and post-mediation supervision. The main findings reveal that this approach has succeeded in creating efficiency in the legal process with an average resolution time of 17 working days, realizing restorative justice oriented towards recovery, and strengthening the social legitimacy of the prosecutor's office through the integration of the local wisdom values of Dalihan Na Tolu. The study concludes that although RJ has shown a transformative impact on the criminal justice system, optimizing its implementation requires the development of more comprehensive standard operating procedures, increased capacity for facilitators, and strengthened collaborative networks with local stakeholders.
