PERAN KEJAKSAAN DALAM MEWUJUDKAN KEADILAN SUBSTANTIF MELALUI RESTORATIVE JUSTICE: TANTANGAN DAN STRATEGI EFEKTIF

Abstrak

Peran Kejaksaan dalam penerapan restorative justice merupakan bentuk nyata dari upaya reformasi sistem peradilan pidana menuju tatanan yang lebih manusiawi, inklusif, dan berfokus pada proses pemulihan. Konsep restorative justice menekankan pada pemulihan kondisi setelah terjadinya tindak pidana melalui dialog dan kesepakatan damai antara pelaku dan korban, bukan sekadar memberikan hukuman kepada pelaku. Dalam sistem hukum positif Indonesia, prinsip ini telah memperoleh dasar hukum melalui Peraturan Kejaksaan Republik Indonesia Nomor 15 Tahun 2020 tentang Penghentian Penuntutan Berdasarkan Keadilan Restoratif. Ketentuan tersebut memperluas peran jaksa, tidak hanya sebagai penuntut umum, tetapi juga sebagai fasilitator, mediator, serta pengendali perkara (dominus litis) yang bertanggung jawab menjaga keseimbangan antara kepentingan hukum, rasa keadilan, dan nilai-nilai kemanusiaan.

The role of the Prosecutor's Office in the implementation of restorative justice is a tangible form of efforts to reform the criminal justice system towards a more humane, inclusive, and focused order on the recovery process. The concept of restorative justice emphasizes restoring conditions after the occurrence of a crime through dialogue and a peaceful agreement between the perpetrator and the victim, not just giving punishment to the perpetrator. In Indonesia's positive legal system, this principle has gained a legal basis through the Prosecutor's Regulation of the Republic of Indonesia Number 15 of 2020 concerning the Termination of Prosecutions Based on Restorative Justice. This provision expands the role of the prosecutor, not only as a public prosecutor, but also as a facilitator, mediator, and controller of cases (dominus litis) who is responsible for maintaining a balance between legal interests, a sense of justice, and human values.
