ANALISIS HUKUM PIDANA TERHADAP PENYALAHGUNAAN TEKNOLOGI DEEPFAKE BERBASIS ARTIFICIAL INTELLIGENCE DI INDONESIA

Perkembangan teknologi Artificial Intelligence (AI) telah melahirkan inovasi berupa teknologi deepfake yang mampu memanipulasi audio, gambar, dan video secara realistis. Meskipun teknologi ini memiliki manfaat dalam bidang hiburan dan industri kreatif, penyalahgunaannya berpotensi menimbulkan berbagai tindak pidana seperti penipuan digital, pencemaran nama baik, pornografi non-konsensual, dan penyebaran berita bohong. Permasalahan dalam penelitian ini adalah bagaimana pengaturan hukum pidana terhadap penyalahgunaan teknologi deepfake di Indonesia serta bagaimana bentuk pertanggungjawaban pidana terhadap pelaku. Penelitian ini menggunakan metode penelitian hukum normatif dengan pendekatan perundang-undangan dan pendekatan konseptual. Data diperoleh melalui studi kepustakaan terhadap peraturan perundang-undangan, buku, dan jurnal ilmiah yang relevan. Hasil penelitian menunjukkan bahwa Indonesia belum memiliki regulasi khusus mengenai deepfake, namun beberapa ketentuan dalam KUHP, UU ITE, UU Pornografi, dan UU Pelindungan Data Pribadi dapat digunakan untuk menjerat pelaku. Oleh karena itu, diperlukan pembentukan regulasi khusus terkait deepfake guna memberikan kepastian hukum dan meningkatkan efektivitas penegakan hukum di Indonesia.
The development of Artificial Intelligence (AI) technology has led to the emergence of deepfake technology capable of realistically manipulating audio, images, and videos. Although this technology provides benefits in entertainment and creative industries, its misuse has the potential to create various criminal acts such as digital fraud, defamation, non-consensual pornography, and the dissemination of false information. The problems discussed in this study are the regulation of criminal law regarding the misuse of deepfake technology in Indonesia and the forms of criminal liability imposed on perpetrators. This research employs a normative legal research method using statutory and conceptual approaches. Data were collected through library research by examining laws and regulations, books, and relevant scientific journals. The results show that Indonesia does not yet have specific regulations governing deepfake technology; however, several provisions in the Criminal Code, the Electronic Information and Transactions Law, the Pornography Law, and the Personal Data Protection Law can be applied against offenders. Therefore, specific regulations concerning deepfake technology are needed to provide legal certainty and improve the effectiveness of law enforcement in Indonesia.
