ANALISIS YURIDIS TERHADAP PUTUSAN MAHKAMAH KONSTITUSI NOMOR 132/PHPU.BUP-XXIII/2025 MENGENAI DISKUALIFIKASI CALON BUPATI DAN PEMUNGUTAN SUARA ULANG PADA PEMILIHAN KEPALA DAERAH KABUPATEN TASIKMALAYA

Abstrak

Pemilihan kepala daerah merupakan salah satu instrumen rotasi kepemimpinan yang esensial demi terwujudnya kedaulatan rakyat dalam sistem demokrasi. Namun, dinamika penyelenggaraan Pemilihan Bupati dan Wakil Bupati Kabupaten Tasikmalaya Tahun 2024 memicu polemik hukum. Komisi Pemilihan Umum (KPU) meloloskan petahana H. Ade Sugianto yang diduga telah menjabat selama dua periode akibat adanya perbedaan penafsiran terkait perhitungan masa jabatan. Hal ini mendorong pasangan calon kompetitor, Cecep Nurul Yakin dan Asep Sopari Al-Ayubi, untuk mengajukan permohonan sengketa perselisihan hasil ke Mahkamah Konstitusi (MK). Metode penelitian yang digunakan adalah penelitian hukum sosiologis dengan pendekatan empiris. Sumber data terdiri dari data primer dan data sekunder yang diperoleh melalui wawancara, observasi, studi kepustakaan, dan dokumentasi. Hasil penelitian menyimpulkan bahwa: Pertama, duduk perkara dalam permohonan ini berkaitan dengan pemenuhan syarat tenggat waktu permohonan, legal standing pemohon sebagai salah satu kandidat, serta kewenangan MK untuk memeriksa peristiwa khusus (kekeliruan syarat pencalonan) terlepas dari terpenuhi atau tidaknya batas ambang selisih perolehan suara formal. Kedua, dalam pertimbangan hukumnya, Mahkamah Konstitusi menegaskan bahwa masa jabatan H. Ade Sugianto secara riil dan faktual telah melampaui dua periode apabila dihitung sejak ia resmi melaksanakan tugas sehari-hari sebagai Bupati berdasarkan Radiogram Gubernur, bukan sekadar melihat dari tanggal penamaan status definitifnya saja. Implikasinya, Mahkamah Konstitusi menjatuhkan sanksi diskualifikasi terhadap H. Ade Sugianto selaku Calon Bupati nomor urut 3 dan memerintahkan KPU untuk melaksanakan Pemungutan Suara Ulang (PSU) dalam jangka waktu paling lama 60 hari tanpa mengikutsertakan yang bersangkutan.

Regional head elections serve as an essential instrument for leadership rotation to realize popular sovereignty within a democratic system. However, the dynamics of the 2024 Regency Head and Deputy Regency Head Election in Tasikmalaya Regency triggered a legal polemic. The General Elections Commission (KPU) passed the incumbent, H. Ade Sugianto, who was alleged to have served for two terms due to differing interpretations regarding the calculation of the term of office. This prompted the competing candidate pair, Cecep Nurul Yakin and Asep Sopari Al-Ayubi, to file a dispute over the election results with the Constitutional Court (MK). The research method applied is sociological legal research using an empirical approach. Data sources consist of primary and secondary data obtained through interviews, observations, literature studies, and documentation. The results of the research conclude that: First, the merits of the case in this petition relate to the fulfillment of the petition deadline requirements, the petitioner's legal standing as one of the candidates, and the authority of the Constitutional Court to examine specific occurrences (errors in candidacy requirements) regardless of whether the formal vote margin threshold is met. Second, in its legal considerations, the Constitutional Court emphasized that the term of office of H. Ade Sugianto had realistically and factually exceeded two terms when calculated from the time he officially executed daily duties as Regent based on the Governor's Radiogram, rather than merely looking at the date of his definitive status designation. Consequently, the Constitutional Court imposed a disqualification sanction on H. Ade Sugianto as Candidate for Regent number 3 and ordered the KPU to conduct a Re-Vote (PSU) within a maximum period of 60 days without the participation of the concerned party.
