ANALISIS PERLINDUNGAN HUKUM TERHADAP WARTAWAN DI KABUPATEN GROBOGAN

Perlindungan hukum terhadap wartawan merupakan elemen fundamental dalam menjamin kebebasan pers dan demokrasi. Undang-Undang Nomor 40 Tahun 1999 tentang Pers, khususnya Pasal 8, secara eksplisit menyatakan bahwa wartawan mendapat perlindungan hukum dalam menjalankan profesinya. Perlindungan ini mencakup hak untuk mencari, memperoleh, memiliki, menyimpan, mengolah, dan menyebarluaskan informasi kepada publik. Namun, dalam praktiknya, implementasi perlindungan tersebut masih menghadapi berbagai tantangan. Maraknya kekerasan, intimidasi, dan kriminalisasi terhadap wartawan, baik secara fisik maupun psikologis, menunjukkan bahwa jaminan hukum belum sepenuhnya efektif. Data dari organisasi seperti AJI dan Reporters Without Borders menunjukkan peningkatan jumlah kasus kekerasan terhadap jurnalis, termasuk ancaman, pengusiran, hingga pembunuhan. Kondisi ini semakin diperparah oleh lemahnya pemahaman aparat penegak hukum terhadap UU Pers serta penggunaan Undang-Undang ITE untuk menjerat wartawan. Oleh karena itu, diperlukan langkah konkret seperti peningkatan literasi hukum, advokasi berkelanjutan, serta penguatan peran Dewan Pers dan lembaga media dalam melindungi wartawan, khususnya di daerah. Kajian ini berupaya memberikan analisis terhadap efektivitas perlindungan hukum wartawan di Indonesia berdasarkan UU No. 40 Tahun 1999 dan urgensi penguatan sistem perlindungan menyeluruh dalam menghadapi tantangan zaman.
Legal protection for journalists is a fundamental element in ensuring press freedom and democracy. Law Number 40 of 1999 concerning the Press, particularly Article 8, explicitly states that journalists are entitled to legal protection in carrying out their professional duties. This protection includes the right to seek, obtain, possess, store, process, and disseminate information to the public. However, in practice, the implementation of such protection still faces significant challenges. The increasing incidents of violence, intimidation, and criminalization against journalists—both physically and psychologically—indicate that legal guarantees are not yet fully effective. Data from organizations such as AJI and Reporters Without Borders show a rising trend in violence against journalists, including threats, forced evictions, and even murder. These conditions are exacerbated by the lack of understanding among law enforcement officers regarding the Press Law and the misuse of the Electronic Information and Transactions (ITE) Law to prosecute journalists. Therefore, concrete actions are needed, such as increasing legal literacy, continuous advocacy, and strengthening the roles of the Press Council and media institutions in protecting journalists, especially at the regional level. This study aims to analyze the effectiveness of legal protection for journalists in Indonesia based on Law No. 40 of 1999 and the urgency of strengthening a comprehensive protection system to address current challenges.
