STRATEGI PENASEHAT HUKUM DALAM MELAKUKAN PEMBELAAN TERHADAP PELAKU PENGEDAR NARKOBA

Abstrak

Penasehat hukum memiliki peran sentral dalam menjamin hak-hak terdakwa pada setiap tahap proses peradilan pidana, termasuk dalam perkara narkotika yang memiliki kompleksitas tinggi dan ancaman pidana berat. Penelitian ini bertujuan untuk menganalisis strategi pembelaan hukum yang dilakukan oleh penasehat hukum terhadap pelaku tindak pidana pengedaran narkoba, serta menelaah tantangan yang dihadapi dalam praktiknya di Indonesia. Penelitian ini menggunakan metode hukum normatif dengan pendekatan perundang-undangan dan konseptual. Hasil penelitian menunjukkan bahwa strategi pembelaan umumnya mencakup pembantahan unsur delik, pengajuan keberatan atas cacat prosedural, serta pendekatan kemanusiaan melalui rehabilitasi dan keadilan restoratif. Namun, penerapan strategi tersebut menghadapi hambatan signifikan berupa keterbatasan akses terhadap berkas perkara, tekanan aparat penegak hukum, stigma sosial terhadap advokat, dan sistem hukum yang masih cenderung represif.

Legal counsel has a central role in guaranteeing the rights of defendants at every stage of the criminal justice process, including in narcotics cases that have high complexity and severe criminal threats. This study aims to analyze the legal defense strategies carried out by legal advisors against perpetrators of drug trafficking crimes, as well as examine the challenges faced in their practice in Indonesia. This research uses normative legal methods with legislative and conceptual approaches. The results of the study show that defense strategies generally include the denial of delicacy elements, the filing of objections to procedural defects, and a humanitarian approach through rehabilitation and restorative justice. However, the implementation of the strategy faces significant obstacles in the form of limited access to case files, pressure from law enforcement officials, social stigma against advocates, and a legal system that still tends to be repressive.
