PENGGUNAAN GAS AIR MATA SEBAGAI ALAT PENEGAKAN HUKUM DALAM PENGENDALIAN KERUSUHAN DITINJAU DARI HUKUM HAK ASASI MANUSIA INTERNASIONAL

Abstrak

Penggunaan gas air mata oleh aparat sering disalahgunakan secara berlebihan dan tidak proporsional dalam menangani kerusuhan. Tindakan represif ini memicu penderitaan fisik hingga korban jiwa yang mencederai hak atas hidup dan kebebasan berkumpul. Oleh karena itu, praktik penyalahgunaan ini perlu dievaluasi lebih lanjut berdasarkan standar hukum hak asasi manusia internasional. Penelitian ini bertujuan mengkaji penggunaan gas air mata dan wujud tanggung jawab negara atas pelanggarannya.  Penelitian ini menggunakan metode penelitian hukum normatif yang bersifat deskriptif dengan pendekatan kualitatif melalui studi kepustakaan untuk menilai kesesuaian antara tindakan di lapangan dengan norma atau prinsip hukum yang berlaku. Analisis dalam penelitian ini difokuskan pada pengkajian asas-asas hukum, khususnya asas tanggung jawab negara (state responsibility). Sumber data yang dikumpulkan mencakup bahan hukum primer berupa instrumen hukum internasional seperti UDHR 1948, ICCPR 1966, United Nation Basic Principles on the Use of Force and Firearms by Law Enforcement Officials 1990, dan ARSIWA 2001. Selain itu, penelitian ini juga didukung oleh bahan hukum sekunder seperti buku, jurnal, dan literatur terkait perlindungan HAM, serta bahan hukum tersier seperti kamus hukum untuk memberikan petunjuk dan penjelasan tambahan. Hasil penelitian menegaskan bahwa penyalahgunaan gas air mata merupakan pelanggaran nyata terhadap hukum hak asasi manusia internasional. Tindakan represif aparat yang berlebihan tersebut dapat diatribusikan secara langsung sebagai perbuatan resmi negara. Akibatnya, negara dinilai gagal melindungi rakyatnya dan wajib memikul pertanggungjawaban atas pelanggaran tersebut berdasarkan hukum internasional.

The use of tear gas by authorities is often abused in an excessive and disproportionate manner when managing civil unrest. These repressive actions lead to physical suffering and even fatalities, violating the right to life and the freedom of assembly. Therefore, these abusive practices warrant further evaluation based on international human rights law standards. This research aims to examine the use of tear gas and the manifestation of state responsibility for its violations. This research employs a descriptive normative legal research method with a qualitative approach through a literature study to assess the conformity between actions in the field and the applicable legal norms or principles. The analysis in this study focuses on examining legal principles, particularly the principle of state responsibility. The collected data sources include primary legal materials in the form of international legal instruments such as the 1948 UDHR, the 1966 ICCPR, the 1990 United Nations Basic Principles on the Use of Force and Firearms by Law Enforcement Officials, and the 2001 ARSIWA. Furthermore, this research is also supported by secondary legal materials such as books, journals, and literature related to human rights protection, as well as tertiary legal materials such as legal dictionaries to provide additional guidance and explanation. The findings assert that the misuse of tear gas constitutes a clear violation of international human rights law. Such excessive repressive actions by authorities can be directly attributed as official acts of the state. Consequently, the state is deemed to have failed in protecting its citizens and must bear responsibility for these violations under international law.
