PERANAN JAKSA DALAM PEMBUKTIAN PERENCANAAN PEMBUNUHAN: ANALISIS JEDA WAKTU DAN RANGKAIAN PERBUATAN TERDAKWA

Abstrak

Tindak pidana pembunuhan berencana, yang semula diatur dalam Pasal 340 Kitab Undang-Undang Hukum Pidana (KUHP) lama dan kini berkorelasi dengan Pasal 459 Undang-Undang Nomor 1 Tahun 2023 tentang KUHP Nasional yang berlaku efektif sejak 2 Januari 2026, menuntut pembuktian unsur subjektif yang paling kompleks, yaitu “dengan rencana terlebih dahulu” (met de voorbedachten rade). Penelitian yuridis-normatif ini menggunakan pendekatan undang-undang (termasuk perbandingan sinkronis antara KUHP lama dan KUHP Nasional), pendekatan konsep, dan studi kasus Putusan Nomor 551/Pid.B/2025/PN Rap, serta didukung data wawancara dengan Jaksa Penuntut Umum (JPU), guna mengonstruksi solusi penguatan peran JPU dalam dilema pembuktian ini. Hasil kajian menunjukkan bahwa JPU dalam Putusan 551/Pid.B/2025/PN Rap (dengan jeda waktu sekitar 15 menit) berhasil menggeser fokus pembuktian dari kuantitas waktu menjadi kualitas persiapan objektif, seperti keputusan sadar memilih pisau egrek dan menyerang korban yang sedang tidur. Konstruksi pembuktian tersebut tetap relevan sepenuhnya di bawah Pasal 459 KUHP Nasional, karena perubahan yang dilakukan bersifat redaksional dan tidak mengubah substansi unsur perencanaan. Namun, strategi ini secara empiris rentan terhadap argumen pembelaan berbasis emosi spontan, sehingga menggarisbawahi perlunya rangkaian perbuatan yang runtut, konsisten, dan bertujuan sebagai proksi objektif atas terbentuknya kehendak, tersedianya jeda waktu untuk menimbang, dan terlaksananya perbuatan dalam suasana tenang, guna mengobjektifkan subjektivitas rustige overlegging pelaku. Penguatan peran JPU melalui konstruksi rangkaian perbuatan ini akan menghasilkan konstruksi yuridis yang lebih kokoh, konsisten dengan KUHP dan KUHAP Nasional, serta menegakkan keadilan substantif Pasal 459 KUHP Nasional.

The crime of premeditated murder, formerly regulated under Article 340 of the old Criminal Code and now correlated with Article 459 of Law Number 1 of 2023 on the National Criminal Code (effective since 2 January 2026), requires proof of the most complex subjective element, namely “with a plan in advance” (met de voorbedachten rade). This juridical-normative research uses a statute approach (including a synchronic comparison between the old Criminal Code and the National Criminal Code), a conceptual approach, and a case study of Decision Number 551/Pid.B/2025/PN Rap, supported by interview data with a public prosecutor, to construct a solution strengthening the prosecutor’s role in this evidentiary dilemma. The results show that the prosecutor in Decision 551/Pid.B/2025/PN Rap (with a time gap of about 15 minutes) succeeded in shifting the focus of proof from the quantity of time to the quality of objective preparation, such as the conscious choice of a sickle-knife and the attack on a sleeping victim. This evidentiary construction remains fully relevant under Article 459 of the National Criminal Code, since the change is redactional rather than substantive. However, this strategy is empirically vulnerable to defense arguments based on sudden emotion, underscoring the need for a coherent, consistent, and purposeful chain of conduct as an objective proxy for the formation of intent, the availability of a time gap for deliberation, and the execution of the act in a calm state of mind. Strengthening the prosecutor’s role through this chain-of-conduct construction will produce a more robust juridical construction, consistent with the National Criminal Code and Criminal Procedure Code, and uphold the substantive justice of Article 459 of the National Criminal Code.
