PERLINDUNGAN HUKUM LAHAN PERTANIAN PANGAN BERKELANJUTAN, PETANI DAN GENERASI TANI DALAM SISTEM KEDAULATAN PANGAN NASIONAL

Abstrak

There has been inconsistency in the Legislative Regulations on the Protection of Sustainable Agricultural Land. Law No. 41 of 2009 on the Protection of Sustainable Food Farmland safeguards sustainable agricultural land. The Law No. 6 of 2023 on the Establishment of Government Regulations has replaced the Law No. 2 of 2022 on Job Creation, which does not guarantee such protection. Article 44 of Law No. 41 of 2009 on the Protection of Sustainable Food Farmland was repealed, hastening the transfer of agricultural land and eliminating the requirement to give replacement land to affected farmers. This study examines Law 41 of 2009 on the Protection of Sustainable Agriculture and Food Land, as well as Law 6 of 2023 on the Establishment of Government Regulations to Replace Law 2 of 2022 on Job Creation. It gives the government, the Ministry of Forestry, the Ministries of Agriculture, and the National Farm Office some perspective on the existence of permanent farmland, which is helpful for the development of state law, particularly in relation to that subject.
