Tujuannya adalah memberikan kesempatan bagi anak untuk memperbaiki diri tanpa menghadapi stigmatisasi sosial. Pelaksanaan Keadilan Restoratif mencakup proses rehabilitasi, pendidikan, dan perlindungan bagi korban serta anak pelaku, agar mereka dapat berintegrasi kembali dengan baik ke dalam masyarakat. Diharapkan pendekatan ini dapat mencegah perilaku kriminal yang terulang pada anak dan memastikan perlindungan hukum yang adil dan proporsional bagi anak yang berkonflik dengan hukum.
The enforcement of criminal law in addressing cases of violence committed by minors in Indonesia focuses on the Restorative Justice approach. This method emphasizes restoring the relationship between the offender and the victim rather than merely imposing punishment. In managing cases of violence involving children, the Law on the Juvenile Criminal Justice System (UU SPPA) promotes the use of diversion, which involves shifting case resolution from the formal judicial system to alternative solutions outside of court. The aim is to provide children with opportunities for self-improvement without facing social stigma. The implementation of Restorative Justice includes processes of rehabilitation, education, and protection for both victims and child offenders, allowing them to reintegrate into society effectively. This approach is anticipated to help prevent recidivism among children and ensure fair and proportionate legal protection for minors in conflict with the law.
