EFEKTIVITAS PENGGUNAAN E-COURT DALAM HAL PENYELESAIAN PERKARA PERDATA PADA PENGADILAN NEGERI LUBUK PAKAM

Abstrak

Efektivitas penggunaan E-Court dalam penyelesaian perkara dapat dilihat dari dua sudut pandang, yaitu aturan hukum yang mengaturnya dan bagaimana aturan hukum itu di implementasikan, hasil penelitan penulis menunjukkan bahwa efektivitas daripada E-court cukup membantu terciptanya akses yang luas dan mudah bagi masyarakat untuk mencari keadilan, serta tercapainya peradilan sederhana, cepat dan biaya ringan, namun ditemukan beberapa kelemahan dalam E-Court itu sendiri maupun pelaksanaannya, yang kedepannya tentu harus diperbaiki. Tujuan daripada penulisan karya ilmiah ini adalah untuk mengetahui bagaimana efektivitas penggunaan E-Court dalam penyelesaian perkara perdata pada Pengadilan Negeri Lubuk Pakam. Metode penelitian dalam karya ilmiah ini bersifat deskriptif analisis yaitu dari penelitian diharapkan diperolehnya gambaran secara rinci serta sistematis tentang permasalahan yang diteliti. Adapun metode pendekatan pada penelitian ini menggunakan jenis pendekatan empiris, yang berfokus untuk menggambarkan kondisi yang dilihat dilapangan secara apa adanya.

The effectiveness of the use of E-Court in case settlement can be seen from two points of view, namely the legal rules that regulate it and how the legal rules are implemented, the results of the author's research show that the effectiveness of E-Court is quite helpful in creating broad and easy access for the public to seek justice, as well as achieving simple, fast and low-cost justice, but there are some weaknesses in E-Court itself and its implementation, which certainly need to be improved in the future. The purpose of this research paper is to find out the effectiveness of the use of E-Court in the settlement of civil cases at the Lubuk Pakam District Court. The research method in this scientific work is descriptive analysis, that is, the research is expected to provide a detailed and systematic description of the problems studied. The method of approach in this research uses an empirical approach, which focuses on describing the conditions seen in the field as they are.
