TINJAUAN PENYELESAIAN SENGKETA TANAH WARISAN MENURUT HUKUM POSITIF INDONESIA

Tujuan Penulisan Penelitian ini ialah untuk menggali dan memahami tentang tinjauan penyelesaian sengketa tanah warisan menurut hukum positif Indonesia. secara umu warisan merupakan suatu kepemilikan atas kekayaan,harta ataupun benda dari seseorang yang sudah meninggal. Harta ataupun benda tersebut kemudia diserahkan kepada ahli waris sebagai pihak yang memiliki hak untuk menerima harta tersebut. akan tetapi, dalam proses penyerahan harta tanah warisan tersebut sering sekali terjadi sengketa ataupun permasalahan hukum antara ahli waris sehingga sangat dibutuhkan metode ataupun cara penyelesaian sengeta tanah warisan tersebut. untuk mendukung penelitian ini, penulis menggunakan metode penelitian secara yuridis, normatif. Dimana dalam metode ini berfokus kepada peraturan perundang-undangan, norma hukum dan juga permasalahan hukum yang berkaitan dengan penulisan ini. Dalam teknik pengumpulan data, penelitian ini berfokus studi kepustakaan (library research) dimana Buku, Undang-Undang dan juga literatur-literatur yang berkaitan dengan sengketa tanah warisan ini.
The purpose of writing this research is to explore and understand the review of the settlement of inherited land disputes according to Indonesian positive law. in general, inheritance is an ownership of wealth, property or objects from someone who has died. The property or object is then handed over to the heirs as the party who has the right to receive the property. however, in the process of handing over the inherited land property, disputes or legal problems often occur between the heirs so that a method or way of resolving the inherited land dispute is needed. to support this research, the author uses a juridical, normative research method. Where in this method focuses on legislation, legal norms and also legal issues related to this writing. In data collection techniques, this research focuses on library research where books, laws and also literature related to this inherited land dispute.
