PENGUATAN KELEMBAGAAN BAWASLU UNTUK MENJAMIN PEMILU YANG BERSIH DAN DEMOKRATIS

Abstrak

Pemilihan Umum adalah sebuah perwujudan kedaulatan rakyat di Indonesia. Sebagai salah satu bentuk demokrasi, Pemilu harus terselenggara dengan memenuhi prinsip bersih, jujur dan adil. Undang Undang Nomor 7 tahun 2017 pasal 101 telah mengamanatkan Badan Pengawas Pemilu sebagai badan yang bertugas mengawasi proses demokrasi elektoral mulai dari Pemilihan Legislatif, Pemilihan Kepada Daerah, dan Pemilihan Presiden. Sebagai badan yang diamatkan secara konstitusional dalam hal pengawasan pemilu, sebuah inovasi dibutuhkan dalam meningkatkan nilai guna pengawasan untuk mewujudkan pemilu yang bersih dan demokratis. Paper ini akan menjelaskan Penguatan Kelembagaan Badan Pengawas Pemilihan Umum untuk Menjamin Pemilihan Umum yang Bersih dan Demokratis. Penelitian ini adalah penelitian hukum normatif dengan pendekatan kualitatif. Hasil penelitian menunjukkan setidaknya pada tataran normatif pengaturan Peran Kelembagaan Badan Pengawas Pemilihan Umum (Bawaslu) Berdasarkan Undang-Undang Nomor 7 Tahun 2017 menjadikan Bawaslu secara kelembagaan sesuai tingkatnnya masing-masing semakin kuat dan mandiri.

Elections are a manifestation of people's sovereignty in Indonesia. As a form of democracy, elections must be held in accordance with the principles of clean, honest and fair. Law Number 7 of 2017 Article 101 has mandated the Election Supervisory Body as a body tasked with supervising the electoral democracy process starting from the Legislative Election, Regional Head Election, and Presidential Election. As a body that is constitutionally observed in terms of election supervision, an innovation is needed to increase the utility of supervision to realize clean and democratic elections. This paper will explain the Strengthening of the Election Supervisory Body Institution to Ensure Clean and Democratic Elections. This research is a normative legal research with a qualitative approach. The results of the study show that at least at the normative level, the regulation of the Institutional Role of the Election Supervisory Body (Bawaslu) Based on Law Number 7 of 2017 makes Bawaslu institutionally according to their respective levels increasingly strong and independent.
