KONSISTENSI PUTUSAN HAKIM DALAM PENERAPAN KOMPILASI HUKUM KELUARGA ISLAM ( KHI ) DI PENGADILAN AGAMA PROBOLINGGO PERSPEKTIF KONSTRUKSI SOSIAL.

Abstrak

 Konsistensi putusan hakim dalam penerapan Kompilasi Hukum Islam (KHI) di Pengadilan Agama merupakan isu yang sering menjadi perhatian, khususnya dalam perspektif keadilan dan kepastian hukum. Penelitian ini bertujuan untuk menganalisis konsistensi putusan hakim di Pengadilan Agama Probolinggo dalam menerapkan KHI serta mengkaji fenomena tersebut melalui perspektif teori konstruksi sosial. Pendekatan penelitian ini adalah kualitatif dengan metode studi kasus, memanfaatkan analisis dokumen putusan hakim, wawancara mendalam, dan observasi lapangan. Hasil penelitian menunjukkan bahwa terdapat variasi dalam penerapan KHI di Pengadilan Agama Probolinggo, yang dipengaruhi oleh latar belakang sosial, budaya, dan pemahaman individu para hakim. Faktor eksternal seperti tekanan sosial, harapan masyarakat, dan nilai-nilai lokal turut memengaruhi konstruksi sosial hakim dalam menafsirkan hukum. Dalam konteks ini, konsistensi putusan tidak semata-mata dilihat sebagai aspek hukum normatif, tetapi juga sebagai hasil dari interaksi dinamis antara hakim dengan lingkungan sosialnya. Penelitian ini menyimpulkan bahwa meskipun KHI dirancang untuk memberikan pedoman yang seragam, penerapannya tetap dipengaruhi oleh berbagai faktor sosial yang membentuk perspektif hakim. Oleh karena itu, diperlukan peningkatan pelatihan bagi hakim dan penguatan sistem pengawasan untuk memastikan bahwa putusan mencerminkan prinsip keadilan dan kepastian hukum tanpa mengabaikan sensitivitas sosial budaya setempat.

The consistency of judicial decisions in applying the Compilation of Islamic Law (KHI) in Religious Courts is an issue that often attracts attention, particularly from the perspectives of justice and legal certainty. This study aims to analyze the consistency of judicial decisions in the Probolinggo Religious Court in applying the KHI and to examine this phenomenon through the perspective of social construction theory. The research employs a qualitative approach with a case study method, utilizing the analysis of judicial decision documents, in-depth interviews, and field observations. The findings reveal that there is variation in the application of the KHI in the Probolinggo Religious Court, influenced by the social, cultural, and individual understanding of the judges. External factors such as social pressures, community expectations, and local values also play a role in shaping the social construction of judges in interpreting the law. In this context, consistency in decisions is not merely seen as a normative legal aspect but also as a result of dynamic interactions between judges and their social environment. This study concludes that although the KHI is designed to provide uniform guidelines, its implementation is still influenced by various social factors that shape the judges' perspectives. Therefore, it is necessary to enhance judges' training and strengthen supervisory systems to ensure that decisions reflect the principles of justice and legal certainty while respecting local socio-cultural sensitivities.
