ANALISIS YURIDIS LAGU “BAYAR BAYAR BAYAR” OLEH BAND SUKATANI DITINJAU DARI ASPEK HUKUM PIDANA

Abstrak

The song "Bayar Bayar Bayar" by the band Sukatani has become a public topic of discussion because it contains social criticism of the practice of levies and corruption by police officers. This criticism has sparked both positive and negative responses, leading to a polemic regarding the limits of freedom of expression in art and its potential conflict with criminal law. This study aims to describe the qualifications of social criticism from an Indonesian legal perspective and analyze the limits of when criticism through song can be considered a criminal offense. This study uses a normative legal method based on literature studies. The results of the discussion indicate that social criticism is part of the constitutional right, freedom of expression, but its implementation is limited by moral values, general agreement, and protection of the honor and reputation of others. The criticism in the song "Bayar Bayar Bayar" does not fulfill the element of hatred based on SARA as stated in the ITE Law, but it can potentially give rise to the crime of defamation if it processes institutional attacks disproportionately. This study recommends that the Police use social criticism as an evaluation, the public be wiser in interpreting criticism in art, and government regulations regarding musical works such as songs.

Lagu “Bayar Bayar Bayar” karya Band Sukatani menjadi perbincangan ormat karena memuat kritik sosial terhadap praktik pungutan liar dan korupsi oleh oknum kepolisian. Kritik tersebut memicu respons pro dan kontra, hingga menimbulkan ormati mengenai batas kebebasan berekspresi dalam karya seni dan kemungkinan pertentangannya dengan hukum pidana. Penelitian ini bertujuan menguraikan kualifikasi kritik sosial dalam perspektif hukum Indonesia dan menganalisis batas kapan suatu kritik melalui lagu dapat dianggap sebagai tindak pidana. Penelitian ini menggunakan metode hukum ormative berbasis studi kepustakaan. Hasil pembahasan menunjukkan bahwa kritik sosial merupakan bagian dari hak konstitusional kebebasan berekspresi, namun pelaksanaannya dibatasi oleh nilai-nilai kesusilaan, ketertiban umum, serta perlindungan terhadap kehormatan dan reputasi pihak lain. Kritik dalam lagu “Bayar Bayar Bayar” tidak memenuhi unsur ujaran kebencian berbasis SARA sebagaimana UU ITE, namun dapat menimbulkan potensi delik pencemaran nama baik apabila ditafsirkan menyerang institusi secara tidak proporsional. Penelitian ini menyarankan agar Kepolisian menjadikan kritik sosial sebagai evaluasi, masyarakat lebih bijak menafsirkan kritik dalam seni, dan pemerintah peraturan terkait karya musik seperti lagu.
