POLITIK HUKUM DAN PENDEKATAN OTONOMI DAERAH DI INDONESIA (ANALISIS DINAMIKA REGULASI, DESENTRALISASI, DAN IMPLEMENTASI KEBIJAKAN)

Abstrak

This study analyzes how national politics influence the development of regulations on regional autonomy, the challenges faced in the political-legal aspects of effectively implementing autonomy, and the effectiveness of the regional autonomy approach in addressing local issues. The findings of this study show that political changes at the national level have a significant impact on the design and direction of decentralization regulations, so that the division of power between the central and regional governments is often influenced by dynamics at the central level. Various challenges in the legal-political aspect arise, such as inconsistent regulations, overlapping authorities, and uneven capacity of regional institutions, which cause the implementation of autonomy to not always be in line with the desired objectives. On the other hand, the regional autonomy approach is able to provide opportunities for regional governments to address local issues more quickly and in accordance with the context, although its success is greatly influenced by the quality of existing regulations and political support. Penelitian ini menganalisis bagaimana politik nasional mempengaruhi pengembangan peraturan mengenai otonomi daerah, tantangan yang dihadapi dalam aspek hukum politik untuk melaksanakan otonomi secara efektif, serta seberapa efektif pendekatan otonomi daerah dalam mengatasi masalah lokal. Temuan dari penelitian ini menunjukkan bahwa perubahan politik di tingkat nasional berpengaruh besar terhadap desain dan arah regulasi desentralisasi, sehingga pembagian kekuasaan antara pusat dan daerah sering kali dipengaruhi oleh dinamika di tingkat pusat. Berbagai tantangan dalam aspek politik hukum muncul, seperti adanya peraturan yang tidak konsisten, tumpang tindih dalam kewenangan, serta ketidakmerataan kapasitas lembaga daerah, yang menyebabkan pelaksanaan otonomi tidak selalu sejalan dengan tujuan yang diinginkan. Di sisi lain, pendekatan otonomi daerah mampu memberi kesempatan kepada pemerintah daerah untuk menangani isu-isu lokal dengan lebih cepat dan sesuai dengan konteks, meskipun keberhasilannya sangat dipengaruhi oleh kualitas peraturan yang ada, dukungan politik yang tersedia, serta kesiapan institusi daerah untuk mengelola kewenangan yang sudah dialokasikan.
