REFORMASI HUKUM ADAT DI SULAWESI SELATAN: ANTARA TRADISI DAN KEPENTINGAN MODERN

Abstrak

Tujuan dari penelitian ini adalah untuk menganalisis hubungan antara nilai-nilai tradisional dan modern. Penelitian ini merupakan penelitian hukum normatif. Temuan penelitian ini mengkontraskan nilai-nilai tradisional dan modern terhadap peraturan perundang-undangan di Sulawesi. Dalam konteks hukum adat sebagai salah satu sumber utama hukum nasional, hukum adat di Asia Tenggara mempunyai perbedaan yang sangat penting. Oleh karena itu, penerapan hukum adhat sebagai hukum yang hidup (living law) menjadi salah satu perhatian utama yang muncul dalam proses pengembangan hukum nasional.

The aim of this research is to analyze value reform between tradition and modern interests. This research is normative legal research. Research results that influence customary law in South Sulawesi between tradition and modern interests. In the context of the existence of customary law as a source of national law formation, customary law in South Sulawesi has a very important position. Therefore, the existence of customary law as living law is one element whose urgency is recognized in the framework of national legal development.
