PERLINDUNGAN HUKUM ATAS DUGAAN EKSPLOITASI EKONOMI PADA ANAK KORBAN DALAM KONTEN MEDIA SOSIAL UNTUK TUJUAN KOMERSIAL

Abstrak

Penelitian ini dilatarbelakangi oleh kasus dugaan eksploitasi ekonomi yang dilakukan kepada anak di media sosial. Hal ini disebabkan oleh perkembangan teknologi yang semakin masif dan tidak dibarengi dengan edukasi serta penegakakn hukum yang mumpuni. Penelitian ini bertujuan untuk mengetahui dan menganalisis perlindungan hukum pada anak korban dugaan eksploitasi ekonomi pada anak yang terjadi di media sosial. Metode penelitian yang digunakan ialah penelitian hukum doktrinal atau yuridis normatif dengan mengkaji aturan, asas, dan doktrin hukum untuk memecahkan isu hukum yang dihadapi. Hasil menunjukkan perlindungan hukum eksploitasi ekonomi anak dalam konten media sosial belum secara efektif melindungi anak dikarenakan tidak adanya unsur eksploitasi ekonomi anak di ruang digital dan jenis tindakan eksploitasi ekonomi dalam Undang-Undang Perlindungan Anak.

This research is motivated by cases of alleged economic exploitation of children occurring on social media. This issue arises due to the rapid development of technology that is not accompanied by adequate education and effective law enforcement. The purpose of this study is to identify and analyze the legal protection afforded to child victims of alleged economic exploitation taking place on social media.The research method used is doctrinal or normative legal research, which examines legal rules, principles, and doctrines to resolve the legal issues at hand. The findings indicate that legal protection against the economic exploitation of children in social media content has not been effectively implemented, due to the absence of clear elements of digital economic exploitation of children and the lack of specific classifications of economic exploitation acts within the Child Protection Law.
