BANGUNAN FILSAFAT ISLAM DALAM BIDANG USHUL FIQH

Abstrak

Pada zaman sekarang ini pengetahuan dan penguasaan ilmu ushul fiqih sangat dibutuhkan untuk memecahkan berbagai masalah hukum islam di dalam masyarakat. Ilmu ushul fiqih menjelaskan cara atau proses istinbath al ahkam sehingga hukum islam menjadi lebih dinamis dan fleksibel. Ilmu ushul fiqih menjadikan masyarakat kita tidak kaku dan keras. Kasus yang terjadi pada hukum Islam sekarang berbeda dan bahkan sama sekali tidak ada padanannya dengan kasus hukum Islam yang telah dirumuskan oleh para ulama fiqih klasik. Sekalipun, ada titik persamaannnya dengan kasus terdahulu, tetapi konteks sosial, budaya, ekonomi, politik dan kepentingan yang melingkupi tentu tidak sama karena ia selalu berkembang searah kemajuan peradaban manusia. Untuk itu, ilmu ushul fiqih sangat diperlukan karena sebagai metodologi istinbâth hukum Islam yang mampu menjawab dan memecahkan persoalan hukum Islam yang menjamur di tengah kehidupan masyarakat kontemporer.

Nowdays, knowledge and mastery of the science of ushul fiqh is very much needed to solve various Islamic legal problems in society. The science of ushul fiqh explains the method or process of istinbath al ahkam so that Islamic law becomes more dynamic and flexible. The science of ushul fiqh makes our society less rigid and harsh. The cases that occur in Islamic law today are different and in fact have no equivalent at all to the cases of Islamic law that have been formulated by classical jurisprudence scholars. Even though there are points of similarity with the previous case, the social, cultural, economic, political context and interests surrounding it are certainly not the same because it always develops in the direction of the progress of human civilization. For this reason, the science of ushul fiqh is very necessary because it is a methodology for Islamic law that is capable of serving and solving problems of Islamic law that are popular in the life of contemporary society.
